Partition Sales

For Partition Referees, Co-Owners & Counsel

Partition Sale Real Estate Broker in Southern California

When co-owners can’t agree — siblings who inherited a home, former partners, or investors at an impasse — a partition action may end with a court-ordered sale. The Aventus Group is an attorney-led brokerage that helps partition referees and counsel sell co-owned property at full market value, with the transparency and documentation the court requires.

We serve partition matters throughout Los Angeles, Orange and San Diego Counties.

How We Support Partition Referees

Referee Appointment & Engagement

Once the court orders a sale and appoints a partition referee, the referee may engage a licensed broker. We provide a written listing proposal, marketing plan and fee structure that the referee can present to the court.

Independent Valuation

We prepare an unbiased, data-driven valuation — as-is and, where relevant, with recommended improvements — so co-owners and the court can see how pricing was determined.

Occupancy & Access

Partition properties are frequently occupied by one co-owner. We coordinate access, showings and occupancy issues with the referee and counsel so the property can be marketed effectively.

Open-Market Sale

We expose the property to the full market through the MLS and Compass channels, collect and summarize all offers, and give the referee a clear recommendation supported by data.

Court Reporting

Every step is documented — marketing activity, showings, offers and counteroffers — to support the referee’s report and any motion to confirm the sale.

Neutral Communication

We serve as a neutral point of contact for all co-owners and their attorneys, which reduces friction and keeps the referee out of interpersonal disputes.

Partition Sale FAQs

What is a partition action in California?

A partition action is a lawsuit, governed by Code of Civil Procedure §872.010 and following, in which a co-owner asks the court to divide jointly owned real property. When physical division is impractical, the court usually orders the property sold and the proceeds divided.

Who sells the property in a partition sale?

The court typically appoints a partition referee to conduct the sale. The referee often engages a licensed real estate broker to market and sell the property under the court’s supervision.

What changed under California’s Partition of Real Property Act?

For partition actions filed on or after January 1, 2023 involving qualifying property, Code of Civil Procedure §874.311 and following add steps such as a court-ordered appraisal and an opportunity for co-owners to buy out other interests before a sale. If a sale is ordered, it is generally an open-market sale through a licensed real estate broker. Ask counsel whether the Act applies to your property.

Can a co-owner buy out the others instead of selling?

Often, yes. Co-owners can agree to a buyout at any time, and in cases covered by the Partition of Real Property Act the law provides a structured buyout opportunity. Our valuation can help everyone negotiate from the same facts.
